Unless you are straightlining your way through the game (my fault, I know). I have not done a single side mission (and I'm at the final boss).
The other thing to note is that I am playing on the 360, so I don;t know if the directional has anything to do with it. I press the left on the directional to use a potion, sometimes it will use a potion (about a third of the time), most of the time it pulls up what looks like the Back (select) menu and I then can either press Back to cancel or go through 4-5 options to get to the item, or nothing happens at all and I'm mashing on it until something happens (all while being wailed on).
That last screen looks like it was ripped right out of concept art for one of the 2d games. Amazing. Hopefully the gameplay is as good as the look of it.

If they can prove that (and they would not have included it in their counter-suit unless they can) those scumbags they kicked out are screwed. Meeting with a competitor is the highest form on insubordination you can commit in a private firm. They'll probably settle, paying some percentage of the royalties due.
The reason why I call West and Zampella scumbags is because they are. They took the money from Activision, that means they have to do the job professionally, and slagging off on Treyarch publicly, and speeding up the credits in MW2 when it gets to the Activision staff is pissant. They deserve to be hobos.
I'm less inclined to believe anything that comes out of Activision or Bobby Kotick's filthy pie-hole but we'll see.
The IW guys are screwed. I'm no fan of Activision, or Kottick, but not liking them doesn't change the facts. The IW guys have one thing in their suit and that is that they have not yet been paid royalties for MW2 (why would they have been paid so soon after MW2's release anyway, at least one quarter would have to pass). Activision has proof of them meeting with a competitor, and of them not fulfilling the requirements of their contract (that they happily signed when they sold their company to Activision). They entered into an agreement and failed to conform to that agreement.
We'll never know, this will be settled out of court, but its a case of scumbag vs. scumbag, they deserve each other.

Monolith is owned by Nintendo. So it is not really a surprise they are working with Nintendo, seeing as they are technically a part of Nintendo.
