I think Ubisoft has always owned it they published the first one. It was just that Crytek was the developer on the first game in the series.

Same deal as what happened with Legacy Of Kain....Silicon Knights created it but Crystal Dynamics owned the rights through some kind of publishing deal. So it became CD's franchise to do whatever they wanted with. Same deal with Far Cry.....Crytek created it, Ubisoft owns it.
